The journal “Juridical Sciences and Education” published an article by an employee of our Institute, Aydin Aliyev, on the topic: “Constitutional norms of direct action, providing accused with the right to defense, and their specification in the Criminal Procedure Code of the Republic of Azerbaijan”. The article is devoted to the study of constitutional norms of direct action that ensure the right of the accused to defense. As a result of the research, the author comes to conclusion that the norms provided for in Articles 25 and 66, Article 71 of Part III, as well as Article 147 of the Constitution of the Republic of Azerbaijan, are direct constitutional norms that ensure the right of the accused to defense. These norms can be applied without direct reference to the Code of Criminal Procedure, which is a branch legal act of the Republic of Azerbaijan.
In the article, A. Aliyev notes that in Article 20 of the Code of Criminal Procedure of the Republic of Azerbaijan, some contradictions were made when detailing the provisions of Article 66 of the Constitution of the Republic of Azerbaijan and suggests ways to eliminate them.
