An article by our researcher “Ecological human rights in modern international law” was published

On December 27, an article by an employee of the Institute of Law and Human Rights, Shalala Gasanova “Ecological human rights in modern international law “ was published in the collection of materials of the International scientific and practical conference on the topic “Actual problems of human rights in the modern period”, held by the Police Academy of the Ministry of Internal Affairs of the Republic of Azerbaijan and timed to coincide with the 74th anniversary of the “Universal Declaration of Human Rights”.
The article mainly examines the experience of the European Court of Human Rights (ECtHR) and the interpretation of the attitude towards the right of people to live in a favorable (healthy) environment based on the context of Articles 2 (Right to life) and 8 (Right to respect for private and family life) of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
By citing examples from judicial precedents, the researcher concludes that in cases of violation of the right to life in a healthy and safe environment, it becomes much more difficult in practice to determine this violation in the context of Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. The author points to the possibility of two main options for solving the problem and notes that in addition to the European Convention for the Protection of Human Rights and Fundamental Freedoms, an optional protocol providing for the “right to live in a healthy and safe environment” or the UN Covenant “On Environmental Rights person” can be adopted.
