The training with the support of the Council of Europe took place at the Institute of Law and Human Rights

On September 29, within the framework of joint cooperation with the Council of Europe Directorate General of Human Rights and Rule of Law, training for lawyers on such topic as “Article 6 of the European Convention on Human Rights (ECHR). Court of Justice of Azerbaijan in the perspective of the European Court of Human Rights” was held at the Institute of Law and Human Rights.

Court of Justice of Azerbaijan in the perspective of the European Court of Human Rights” was held at the Institute of Law and Human Rights. The training was attended by 24 employees of the justice departments, prosecution and judicial bodies. 

In his opening speech, Chairman of Board  of the Institute, Mahammad Guluzade, expressed his gratitude to the Head of the Baku Office of the Council of Europe, Ambassador Mr. Petr Zikh, for the support and effective cooperation with the Institute and spoke about the importance of such trainings for lawyers.

Mr. Petr Zikh said that the training  organized within the framework of cooperation with the Institute, will be useful to lawyers and attorneys working in various government agencies. The Ambassador stressed the need of such joint projects being sustainable. Then Petr Zikh gave full information to the participants about the historical development of the activity of the European Court of Human Rights.

Trainer Vusala Muradkhanli made a presentation on “Article 6 of the ECHR: civil-legal aspect”, and trainer-expert, member of the Bar Association, Sevinj Aliyeva made a presentation on the criminal-legal aspect of the same Article.

 The trainers drew attention of the participants to the most important decisions of the European Court of Human Rights (ECtHR), defining the rights of the accused under Article 6, standards and approaches in this process.

In his presentation, legal expert of the Institute, Vafaddin Ibayev gave general comments on the right to appeal to the court, equality of parties in court proceedings and the principle of contention in court proceedings.

During the discussions, access to the court, procedural requirements, the concept of “criminal charge”, presumption of innocence (Article 6.2), guarantee of the right to defense (Article 6.3), the most known violations in the decisions issued against Azerbaijan were discussed and the questions of the participants were answered by the trainers.
