Training on “Protection of Property Rights and the European Convention” Held at the Baku City Executive Authority
On June 18, the Institute of Law and Human Rights organized a training session on “Protection of Property Rights and the European Convention” for employees of the Baku City Executive Authority to enhance their knowledge and skills in the field of property rights protection.
Opening the event, Ramil Gadimquliyev, Head of the Legal and Human Resources Department of the Baku City Executive Power, emphasized the importance of property rights in ensuring human rights and promoting the rule of law. He noted that strengthening knowledge in this area plays a significant role in the professional activities of civil servants.
Vafaddin Ibayev, Deputy Chairman of the Board of the Institute, then spoke about the nature of property rights and the mechanisms available for their protection. Referring to Article 17 of the Universal Declaration of Human Rights and Article 13 of the Constitution of the Republic of Azerbaijan, he stated that property rights are protected under national legislation and that no individual may be arbitrarily deprived of their property.
In his presentation, Orkhan Bashirli, trainer-expert of the Institute, discussed the domestic legal remedies available for the protection of property rights, including proprietary remedies, remedies arising from the law of obligations, and other legal protection mechanisms. He also reviewed cases concerning property rights examined by the European Court of Human Rights.
During the practical session led by Hamlet Babayev, Head of the Human Rights Training and Expertise Department of the Institute, participants took part in group discussions based on hypothetical legal cases. The discussions focused on the validity of the state's public-interest argument, criteria for determining compensation, whether the owner’s right to possession had been violated, and legal prospects regarding the restitution of property.
