Training on the Right to a Fair Trial Held at the Institute of Law and Human Rights

On October 2, a training session on “Article 6 of the European Convention on Human Rights (ECHR): The Right to a Fair Trial” was held at the Institute of Law and Human Rights. A total of 21 people participated in the training, including judges, lawyers, legal professionals from a number of state institutions, as well as lecturers and students of law faculties at higher education institutions.

Opening the training, Vafaddin Ibayev, Deputy Chairman of the Institute's Board, briefed the participants on the Institute's activities and upcoming priorities. He emphasized the importance of studying modern approaches that contribute aimed at the continuous development of professional knowledge and skills in the field of human rights protection.

V. Ibayev noted that enshrining rights in legislation is not sufficient on its own. He emphasized that ensuring their effective protection requires guaranteeing every individual's access to an independent and impartial tribunal. He pointed out that ensuring the right to a fair trial is one of the key conditions for upholding the rule of law and the effective protection of human rights.

As part of the training, presentations were delivered by Hamlet Babayev, Head of Department at the Institute, and trainer-expert Heydar Hasan oghlu Aliyev. During the presentations, the main provisions of Article 6 of the ECHR were analysed, and detailed information was provided on the key elements of the concept of a “fair trial,” including the right of access to a court, an independent and impartial tribunal, trial within a reasonable time, equality of arms, and the adversarial principle.

In addition, issues relating to the requirements for judicial decisions, the presumption of innocence, the right to defence, evidence, the examination of witnesses, and the participation of legal counsel in proceedings were also discussed.

During the training, participants' questions were answered, views were exchanged on the topic, and practical approaches were examined.
