India, the largest democracy in the world, is a modern-day nation that considers marital rape not to be a crime. Not only is not a crime, but it is also a judicially sanctioned form of sexual abuse many Indian women suffer from, sometimes daily, without any possible recourse from the law. This paper will examine the legal position of the Government of India as well as the judicial system in India hold with respect to marital rape. The marital rape exception clause in the Indian Penal Code is unlawful and unconstitutional and creates an unreasonable arbitrary distinction between married women and unmarried women in India. The marital rape immunity, as it currently exists in the law books of India, violates Indian domestic law, constitutional law, as well as India’s international treaty obligations and must be abolished. In making this case, I will examine several articles of the Indian Penal Code, several articles of the Constitution of India, Indian Supreme Court decisions examining marital rape, and India’s international obligations under various conventions India is a signatory to, arguing that India is illegally and unconstitutionally suppressing the rights of women as it pertains to marital rape, thereby denying women justified recourse in violation of domestic as well as international law. Through silence, the judiciary in India recognizes and authorizes marital rape by Indian men, thus legitimizing this particular form of violence against women, simply because they are women and their status exist within society. However, a deeper analysis of the Indian Penal Code, the Constitution of India as well as Indian Supreme Court decisions shows that the marital rape exception clause has lost its legal legitimacy. The State of India must take several steps to ensure the real and transformative change in a society that battles a significant human rights problem with the marital rape exception clause.

In an unhindered market, firms use their resources to meet the expectations of consumers in productive ways; therefore, competition among firms is inevitable. Those firms that use new technologies and produce efficiently can make a profit. This mechanism is only workable when the right to property would be respected and applied. Although this is an undeniable right of individuals, governments seek to bypass the simple rules of the market even in the case of bankruptcy and reallocation. As a prima facie fact, bankruptcy is one of the outcomes of the market process in a free market. In the absence of the government’s apparatus, firms and creditors are free to continue their businesses or to reach an agreement to defer the timing of payment and conducting the insolvency to pay the debts. In spite of this, governments whose political benefits lead them to use interventionist methods such as securing jobs and subsidizing local businesses, enact modern bankruptcy law to protect the insolvent firms, and give them the opportunity of reconstruction. Iran whose modern bankruptcy law has been prepared is the case study of this article. This article discusses that bankruptcy is part of the normal process of the free market, and rule of law ought to guarantee freedom of parties to negotiate and compensation of the creditors in conclusion. A case study is offered to enlighten that the implementation of modern bankruptcy law would not solve the problems because the main problem is the lack of strengthened property rights.

This article provides an overview on the current and potential implications of the global financial crisis on essential human rights, such as, right to work, right to food, right to an adequate standard of living, the right to social security, right to education and it also highlights various types of obligations of states on protection of its people from the effects of crisis. At the same time, the article analyzes that how the violation of these rights affects the growth and occurrence of human trafficking and which measures can be taken by the states to prevent human trafficking and eliminate the negative impacts of crisis.

In this article, we will focus on three themes, the economic rights and their legislative basis, institutional provision of economic rights and as a last theme, constitutional principles of restriction of economic rights and freedoms. The argument of the article is that the fair constitutionalism provides the most effective method for ensuring economic rights, because it addresses an important requirement for application at the domestic level. This article studies “Plants case” heard in October 2006 by Bamberg District Court in Germany and discusses the applicability of the United Nations Convention on Contracts for the International Sales of Goods dated 1980 to this case, the conformity of the goods with the contract under Articles 35-44 and passing of risk to the buyer under Articles 66-70 as well. Specifically, the question that who carries the risk during loading of goods before handing over to the first carrier is answered in accordance with Article 67(1) of the Convention. The article further explores the carrier’s duty to examine goods when it stops before arriving at the destination for unloading other goods and its relation with a buyer’s duty to examine goods. It promotes the points the Court did not take into account with a reference to the Convention and case law. In the Plants case, defining the liability of the parties upon the carriage of goods, including their involvement in the occurrence of the damage to goods has been a disputable issue because the seller had observed the buyer’s instructions to deliver all goods despite the lack of space on the truck. However, this fact and the seller’s notice and warning did not influence the Court’s decision. Hence, the article concludes that unlike the decision of the court, it will not fit in all cases to determine the reasonable time for notification of non-conformity of goods with a sales contract as one month. Furthermore, when the courts apply the Convention, they should be inclined to take into account all details of cases, especially parties’ correspondence that can be read as an acknowledgment of liability.

The article analyzes in detail legal directions and development perspectives of cooperation within OPEC in the field of oil production and export based on disagreements in the legal literature and international documents. It is noted that OPEC plays a significant role in world oil supplies, serving mainly the interests of the member states and in accordance with the principle of ensuring energy security when supplying energy resources. Such an important role of OPEC in the international arena creates the basis for the participation of non-member states in this Organization. The author concludes that, the need for cooperation between oil-producing OPEC member states and non-member oil-producing states is due to the fact that interstate relations in the era of globalization are possible only on the basis of mutual benefit. The fact that
oil exporting countries defended their interests as a result of joint activities within the framework of OPEC served as a legal guarantee in regulating relations with the main oil exporting
countries of individual entities occupying unequal positions (large oil companies, countries with developed economies).
