Pat Carlen Britaniya həbsxana sistemində tibbiləşdirmə yolu ilə reabili-tasiyanın cinsiyyətə xas bir tədbir olduğunu vur-ğulamışdır: Bu cür tibbi müalicə qadın həbsxana-larının fundamental konsepsiyasına çevrildi. Həbs-xana rəhbərliyi tərəfindən müəyyən edilən patolo-ji, bioloji, emosional və xüsusi tibbi müalicə qadın məhbuslara qarşı daha yumşaq idi. Tobacco has been grown for quite a long time. Countries that grow the crop have justified their growing of it based on employment creation for local farmers and the contribution tobacco growing makes to economic emancipation. Despite that, the negative effects posed by tobacco use remain undeniable at a global level. Consequently, the World Health Organization (WHO) adopted the Framework Convention on Tobacco Control (FCTC) in 2003. The Convention is aimed at securing the health of the public from the adverse effects of tobacco and its use. It, therefore, calls on State Parties to adopt measures and strategies aimed at reducing the consumption of tobacco, such as plain packaging of tobacco products. While the Zambian government is aware of the obligations placed on it by the Convention, which it acceded to in 2008, calls for domestication have not been heeded. It will be demonstrated in this article that the failure to domesticate the Convention by the government offends the right to health and, by and large, leaves room for tobacco companies to take advantage of the right to trademark protection over the FCTC plain packaging recommendation.

Həmçinin yazıda həmin sənədlərlə Azərbaycandakı vəkillik peşəsini tənzimləyən aktlar müqayisəli olaraq təhlil edilmiş, milli qanunvericilikdəki boşluqlar müəyyənləşdirilmişdir. Sonda isə Sİ texnologiyasından istifadənin cəmiyyətdə sürətlə yayılmasını nəzərə alaraq qanunvericilikdəki boşluqların aradan qaldırılması üçün təkliflər verilmişdir.

The issue of extraterritorial jurisdiction of the ECHR is no longer confidential, it is openly discussed and often regulated by law. The purpose of this article is to elucidate the contradictory provisions of the European Convention on Human Rights (ECHR) concerning extraterritorial jurisdiction that may arise from a signatory state’s actions on another state’s territory. Additionally, the Strasbourg Court’s application of the Convention to international armed conflicts will be examined. This article aims to clarify the conflicting aspects of the ECHR regarding extraterritorial jurisdiction arising during the activities of a signatory state in the territory of another state and to determine how the Strasbourg Court applied the Convention to international armed conflicts in this context. According to Article 1 of the ECHR, member states are obliged to recognize the rights and freedoms set out in the Convention to everyone “within their jurisdiction”. Nevertheless, the Strasbourg Court did not precisely explain when and how the jurisdiction of the ECHR regarding the extraterritorial actions of signatory states emerged. In other words, there is no particular provision for extraterritorial aspects. Therefore, this study analyzes two essential models presented by the ECtHR for solving the problem. While the spatial model is based on the state’s control over a particular territory, the personal model consists of the power of authority that the state exerts on individuals through its agents. The topic of this article establishes an obvious background by examining numerous court cases on both models. In addition, this research explores the functional and third models under alternative approaches and presents the author’s views on which model will be effective. Additionally, this article provides the author’s arguments after analyzing the ECtHR’s reference to IHL norms through its case law. The author focuses on applying the balance method to solve the problem. In conclusion, this study suggests that extraterritorial jurisdiction under the ECtHR is an important legal tool for maintaining a workable balance between the Convention’s regional identity and its universalist aspirations.

Məhkəmə-nin səlahiyyəti yalnız Konvensiya və Protokolları təfsir etməklə məhdudlaşır. Konvensiyanın on minlərlə iş üzrə ardıcıl təfsir praktikası “Konven-siya hüququ” adlanan unikal fenomenin, faktiki olaraq, yeni normalar sisteminin yaranmasına sə-bəb olmuşdur. Bu sistem ayrıca aktlarda kodeks-ləşdirilmir, presedent hüququ şəklində mövcud-dur, yekun etibarı ilə Konvensiyanın detallandı-rılmış geniş sistemi kimi təsəvvür oluna bilər.

Defamation law is one of the contemporary issues affecting the protection and maintenance of freedom of the press. The laws regulating defamation foster the free expression of thoughts, ideas, opinions, attitudes or emotions and, consequently, take a guarantor role for the development of human beings in a democratic society. Thus, such laws not only decriminalize defamation but also shield the fundamental principles and values. However, taking highly democratic states as role models, most developing countries do not consider the adoption of decriminalization laws on defamation. Meanwhile, common law countries have established specific defamation law practices to protect free speech and the rights of media workers from the superiority of private rights. The Council of Europe also recommended State Parties to take legal actions for decriminalizing defamation. The French and German legal systems, which are top continental law countries in the region, made an effort for the adaptation to that recommendation.

The advent of modern technologies has recently exposed the EU data protection regime to significant changes. In this vein, the General Data Protection Regulation (GDPR) has improved the previous EU data protection regime and regulated the exponentially increasing form of data processing activities – the extraterritorial data processing activities – at the required level. Accordingly, the applicability issue has played an intriguing role within the framework of the GDPR. Herewith, this article will explore the issue of determining the applicable law within the GDPR. Whereas the GDPR has uniform applicability on the EU level at first sight, a closer examination reveals that the regulation of certain substantive issues is left to the discretion of the Member States. That said, the non-existence of the rule on determining the applicable law within the GDPR puts its objective in peril. In this article, the applicability of the GDPR will be analyzed in the context of the territorial and extraterritorial reach. Specifically, the criterion of “establishment” the criterion of “offering goods or services” and “monitoring the data subjects' behaviours” will be examined in greater detail in this regard. Furthermore, this article will delve into the (in)visible issue – the determination of applicable law – in the framework of the GDPR. As regards this issue, the possible mechanisms will be scrutinized, and viable solutions will be suggested to determine the applicable law in case of the overlapping of the Member States’ laws.
